The Georgia LLC operating agreements allow protection for a company and it’s member(s) by having a document that details the ownership and bylaws. It is not required by State law (Statute 14-11-101) that an LLC should have an agreement, although whatever is written in the operating agreement is legally enforceable.

How to Create an LLC in Georgia

All entities in the State of Georgia must be created online. This can be completed by the applicant going to this page and clicking on the link on the bottom of the page.

Before applying, it is best to make sure your company name you select does not already exist in the State. This can be done by entering the LLC name into the Secretary of State’s Business Database (bottom of page). If you find a duplicate name, then you will need to select a different one.
